FMLA overview

The Family and Medical Leave Act of 1993 (FMLA) was created to protect workers while they are on leave to recover from a serious health condition, care for an ailing family member, for the birth or adoption of a child, or for a qualifying exigency related to a family member's active duty or call to active duty . Eligible employees may take up to 12 workweeks of unpaid leave in a 12-month period for the previously stated qualifying reasons.

The 2008 Amendments to the FMLA and regulations included the Military Caregiver Leave. The Military Caregiver Leave entitles employees to take up to 26 weeks of unpaid leave in a continuous 12-month period to care for a family member who was injured or is suffering from a serious illness incurred while in the line of duty and is receiving medical treatment, therapy, or is on an outpatient status or on the temporary disability retired list.
